Today the Illinois Workers' Compensation Commission (IWCC) voted unanimously to repeal the April 16th emergency rule that created a right for injured workers to a rebuttable presumption if they contracted or were exposed to COVID-19 citing that the legal challenge filed on Friday would cause significant delay and create uncertainty for the rule. IWCC Chairman Brennan mentioned the litigation costs as another factor.

Federal Regulations Federal Regulatory Relief --HOS Mar 18 th -- Expanded Expanded Emergency Declaration Under 49 CFR § 390.23 No. 2020-002 (Relating to COVID-19) provides regulatory relief for commercial motor vehicle operations providing direct assistance in support of emergency relief efforts related to the COVID-19 outbreaks. “…Motor carriers and drivers providing DIRECT ASSISTANCE in support of relief efforts related to the COVID-19 outbreaks are granted emergency relief from Parts 390 through 399 of the FMCSR, including Hours-of-Service (HOS).
Yesterday Illinois Governor Pritzker issued Executive Order 20-10. With few exceptions, all individuals currently living within the State of Illinois are ordered to stay at home. Among other things, the order also prohibits some businesses from operating and public and private gatherings of any number of people. The order also differentiates between prohibited and permitted travel.

Beginning January 6, 2020, employers subject to the Clearinghouse final rule will be required to take certain actions in the Clearinghouse. On October 1st, the FMCSA announced that registration is now open for the Congressionally-mandated Commercial Driver’s License Drug and Alcohol Clearinghouse. Commercial driver’s license (CDL) holders, employers, medical review officers, and substance abuse professionals can now visit the Drug and Alcohol Clearinghouse web site and register to create an online user account. Per the DOT FMCSA, "the Clearinghouse will be a secure online database that will allow FMCSA, CMV employers, State Driver Licensing Agencies, and law enforcement officials to identify – in real-time – CDL drivers who have violated federal drug and alcohol testing program requirements, and thereby improve safety on our nation’s roads."
